Who Keeps the Records?
Records are maintained by the contracted Birth to Three (B23) programs that deliver early intervention services on behalf of the Birth to Three System. The Connecticut Office of Early Childhood (OEC), which oversees the system, does not keep individual child records.
Your assigned Birth to Three program is responsible for maintaining and safeguarding your child’s records in compliance with federal and state laws, including the Individuals with Disabilities Education Act (IDEA) Part C and the Federal Education Protection Act (FERPA).

What’s in My Child’s Record?
Each child’s Birth to Three record may include:
- Evaluations and assessments
- Individualized Family Service Plans (IFSPs)
- Visit and service notes
- Letters, emails, and other written communication
- Audio, video, or digital files
You may request and receive copies of any of these documents.
How Long Are Records Kept?
Birth to Three programs keep records for six (6) years after services end.
After that, records may be securely destroyed in accordance with state guidelines.
Can I See My Child’s Record?
Yes. You have the right to inspect and review your child’s record at any time.
Your rights include:
- Requesting help understanding the records
- Asking for copies for your review
- Allowing someone you trust to review the records on your behalf
Parents have the legal right to access their child’s records unless there is documentation provided to the program indicating otherwise, such as a court order or custody ruling.
Can I Ask for a Correction?
Yes. You may request a correction if you believe that information in your child’s record is:
- Inaccurate
- Misleading
- In violation of privacy
How to Request a Correction
- If your child is enrolled in Birth to Three: Contact your service coordinator.
- If your child has exited the Birth to Three System: Contact the service coordinator or program directly.
What If My Request Is Denied?
If a parent or provider disagrees with the decision not to amend the record, the parent may utilize their procedural safeguards and rights for dispute resolution.
Are There Any Fees?
- You are entitled to one free copy of your child’s complete record or any requested parts.
- Additional copies may include a small fee for printing.
- You will not be charged for locating or retrieving the records.
Can I Request Digital Copies?
Some contracted providers may be able to provide records electronically. Please indicate in your request if that is your preference.
Who Else Can See My Child’s Records?
Only individuals authorized under federal or state law may access your child’s record.
The B23 program keeps a log that shows:
- Why they accessed it
- Who accessed the record
- When they accessed it
Can I Send My Child’s Records to Someone Else?
Yes, with your written consent.
